The Licensing Act 2003

A legal regime for regulating the sale of alcohol.

What is it?

The Act and its associated Mandatory Licensing Conditions, plus the statutory guidance developed to complement each of those texts, set out exactly how age restrictions on the sale of alcohol are applied. It is designed to achieve four licensing objectives;

  • the prevention of crime and disorder
  • public safety
  • the prevention of public nuisance
  • the protection of children from harm

 

In particular, the guidance lists acceptable forms of proof of age, and the Act’s requirement for a hologram or ultraviolet mark on the document has, to date, prevented the use of digital forms of proof of age in physical sales.

Who does it affect?

The Act came into force in November 2005 and affects anyone or any organisation that sells alcohol in person or online.

Penalties include unlimited fines and, for breaching orders, even imprisonment.
